1.About these terms
These Terms of Service (the "Terms") are an agreement between you and [Legal entity name] ("Ditto", "we", "us" or "our"). They cover your use of Ditto: the website and app, the learning service that learns your handwriting, and every feature we offer under the Ditto name (together, the "Service").
By creating an account or using Ditto, you agree to these Terms. If you don't agree, please don't use Ditto. When you create an account, we record which version of these Terms you accepted and when.
If you use Ditto for an organisation, such as a school or a shop, you confirm that you're allowed to accept these Terms on its behalf, and "you" includes that organisation.
Our Privacy Policy explains what we do with your personal information. Please read it alongside these Terms.
2.Who can use Ditto
To use Ditto, you must:
- be at least 13 years old;
- if the country where you live sets a higher age for agreeing to online services on your own (16 in some EU countries, for example), be at least that age, or have your parent's or guardian's consent; and
- be allowed to use the Service under the laws that apply to you.
If you're under 18, or under the age of majority where you live, please read these Terms with a parent or guardian. Where the law requires it, they agree to these Terms for you.
If you're a teacher or a school using Ditto with pupils, you're responsible for getting any consent your school or the law requires before pupils use Ditto or before their handwriting is uploaded.
3.Your account
Some features need an account. You sign up with an email address and a password, and confirm your email address before you start.
- Give accurate information, and keep it up to date.
- Keep your password safe and don't share it. You're responsible for what happens in your account, unless it happens because of something we did wrong.
- One person per account. Don't share an account, and don't create one for someone else without their permission.
- If you think someone has used your account without permission, change your password and tell us straight away at [Contact email].
You can use parts of Ditto without an account. If you do, your hands and documents are kept only in your browser, and they're lost if you clear your browser's data or change device.
4.What Ditto does
Ditto learns a person's handwriting from a photo, scan or PDF of a page they wrote, then writes any text you type in that handwriting. You can make notes, cards, letters and worksheets, and download them as PNG, PDF, video or SVG. Ditto also includes:
- Write on a photo, which writes new words on a photographed page in your hand while keeping the paper;
- Real ink, which writes with the photographed ink from your own pages;
- the Assistant, which carries out requests in plain words, such as "mark this like a teacher" or "tidy my notes";
- Real or Ditto?, a game where you guess which page was written by a person; and
- sample hands, tracing worksheets for teachers, mail merge for shops, and single-line SVG files for pen plotters and cutting machines.
Learning a hand is automatic and depends on the pages you give it. A learned hand may not be perfect: some letters may be missing or misread, and the writing may not look exactly like yours. The Assistant uses AI and can make mistakes. Check what Ditto makes before you rely on it or share it.
Which features you can use, and how much, depends on your plan (see section 10).
5.Your content
You own what you bring and what you make
"Your content" means the pages you upload, the text read from them, the hands Ditto learns from them, the text you type, and everything you make with Ditto ("outputs"). Between you and us, you own your content. We don't claim any ownership of your handwriting, your pages or your outputs.
The permission you give us
You give us a worldwide, non-exclusive, royalty-free licence to store, copy, process, transmit and display your content, only as far as we need to run Ditto for you: for example, to read your pages, learn your hand, keep it safe, write with it and show you the results. This licence ends when you delete the content or your account, except for copies in backups (which are deleted within 30 days) and anything the law requires us to keep.
What we will never do
We will never:
- use your pages or your hand to train models for anyone else;
- sell your content;
- use your content for advertising; or
- let anyone else write in your hand, unless you choose to share or export it.
Your responsibilities
You confirm that you have the right to upload your content, that the handwriting is yours or you have the writer's permission (see section 7), and that your content doesn't break the law or anyone else's rights. Pages and letters can contain other people's names and details, so only upload what you're allowed to.
Feedback
If you send us ideas or suggestions, we can use them without owing you anything.
6.Using what you make
How you may use your outputs depends on the plan you had when you made them:
- Pencil (free), Ballpoint and the Day Pass: personal use. That includes your own notes, cards and letters, and materials you make for your own teaching.
- Fountain: personal and commercial use, under the commercial use licence described on the pricing page. For example, cards and notes for your customers, or products and marketing for your business.
"Commercial use" means using outputs to earn money or to promote a business: for example, selling them, using them in products or packaging, or sending them to customers.
Whatever your plan, your outputs must follow the rules in section 7. You're responsible for how you use what you make, including saying that a page was written with Ditto wherever honesty, the law or someone else's rules call for it.
7.Acceptable use
Ditto copies handwriting. That's what makes it useful, and it's why these rules matter. You must not use Ditto, or anything you make with it, to:
- forge a signature, or imitate anyone's handwriting, to deceive someone;
- create a document that appears to be written or signed by someone who didn't write or sign it, such as a will, a cheque, a contract, a prescription, an official form, or a note from a parent, guardian, teacher, doctor or employer;
- impersonate any person or organisation, or mislead people about who wrote something;
- commit fraud or any other crime, or help someone else to;
- teach Ditto someone else's handwriting without their permission (and, for a child, their parent's or guardian's permission too);
- break the academic integrity rules of your school, university or exam board, for example by handing in Ditto-written work where your own handwriting is required. You're responsible for knowing and following those rules;
- harass, bully, threaten or intimidate anyone;
- create or share content that is illegal, or that infringes anyone's intellectual property, privacy or other rights;
- upload viruses, malware or any other harmful code;
- scrape, crawl or access Ditto with bots or scripts, except through features we provide for that, or put an unreasonable load on our systems;
- attack, probe, scan or test the security of Ditto, or get around its security, access controls, usage limits or plan limits;
- reverse engineer, decompile or disassemble Ditto, except as far as the law allows despite this rule;
- resell, rent, sublicense or share access to Ditto or to your account, or offer Ditto as a service to others, unless we've agreed in writing; or
- remove or hide the watermark your plan adds to downloads.
What we do about misuse
If we reasonably believe these rules have been broken, we may remove content, delete a hand learned from someone's handwriting without their permission, limit features, or suspend or close the account. Where it's appropriate, we'll tell you why and give you a chance to respond, unless that would put someone at risk, break the law or get in the way of an investigation. We may report suspected crimes, and we'll cooperate with law enforcement where the law requires us to.
Report misuse. If you think someone has used Ditto to copy your handwriting without permission, forge a document or break these rules in any other way, email [Contact email] and tell us what you saw and where. We read every report.
Found a security problem? Please tell us at the same address instead of testing it further.
8.Our rights in Ditto
Ditto's software, the learning service and its models, the site's design, the sample hands, and the Ditto name and logo belong to us or to the people who license them to us. These Terms give you a personal, non-exclusive, non-transferable licence to use Ditto as your plan allows, for as long as you follow these Terms. They don't give you any other rights in Ditto.
Sample hands are for writing with inside Ditto. Don't extract, copy or redistribute a sample hand itself. Some sample hands are traced from open-licensed typefaces and stay under those licences, which the font credits on the site list.
9.Privacy
Your pages are used only to learn your hand and are kept with it until you delete it. They're never sold and never used to train models for other people. Our Privacy Policy explains what we collect, why, who receives it, how long we keep it and your rights.
10.Plans and payments
Card payments aren't switched on yet. Today's checkout is a demo: it takes no card and charges nothing. The rest of this section applies once we connect a payment processor.
Plans
- Pencil
- Free.
- Ballpoint
- $4.99 a month, or $29.99 a year.
- Student price, for anyone at school or university: $2.99 a month.
- Fountain
- $9.99 a month, or $79 a year. Includes a commercial use licence (section 6).
- Day Pass
- $1.99, paid once, for 24 hours of Ballpoint from the moment you buy it. It doesn't renew.
Prices are in US dollars and may not include taxes such as VAT or sales tax; where tax applies, we'll show it before you pay. The pricing page describes what each plan includes.
Who handles your card
Payments will be handled by a payment processor (for example, Stripe). You give your card details to the processor, not to us: Ditto never sees or stores your full card number. The processor's own terms and privacy policy also apply to your payment.
Renewal and cancelling
- Monthly and yearly plans renew automatically at the end of each period, at the price in force at the time, until you cancel. We'll show you the renewal terms before you subscribe.
- You can cancel at any time. Cancelling stops the next renewal, and you keep your paid features until the end of the period you've already paid for.
- If a payment fails, we may move you to Pencil until it's paid.
Student price
The student price is for people currently studying at a school or university. We may ask for reasonable proof. If you aren't eligible, we may move you to the standard price from your next billing period, after telling you.
Refunds
Where the law gives you the right to cancel an online purchase within 14 days (for example, as a consumer in the EU or the UK), you can cancel within 14 days of buying and we'll refund you. If you asked for your plan to start straight away, we may keep an amount for the time you've used, where the law allows. A Day Pass whose 24 hours have been used can't be cancelled for a refund, where the law allows that.
Apart from this, we give refunds where the law requires them, and otherwise at our discretion. We don't refund the unused part of a period you cancel, unless the law requires it or these Terms say otherwise.
Price changes
We may change our prices. We'll tell you at least 30 days before a new price applies to your subscription, and it will apply from your first renewal after that. If you don't want to pay the new price, cancel before it takes effect.
11.Services we rely on
Ditto uses services from other companies: Supabase for accounts and storage, Anthropic's Claude for the Assistant, Google Fonts for type and, once payments are live, a payment processor. The Privacy Policy lists what each of them receives. If one of them is unavailable, parts of Ditto may be too.
Links to other websites are there for convenience. We're not responsible for those websites.
12.Availability and changes
We work to keep Ditto running well, but we can't promise it will always be available, uninterrupted or free of errors. We may need to pause it for maintenance, for security, or for reasons outside our control.
We keep improving Ditto, so we may change, add or remove features. If we remove something important you've paid for, we'll tell you in advance where we reasonably can. If a change materially reduces what you paid for, you can cancel and we'll refund the unused part of your current period.
Keep copies of anything important. You can export your data from Settings and download what you make. Anything kept only in your browser is lost if you clear your browser's data.
13.Suspension and termination
If you want to leave
You can stop using Ditto at any time and delete your account from Settings. Deleting your account removes your profile, your pages, subjects and settings, the hands saved in your account and your sign-in, and stops any subscription from renewing (refunds follow section 10). The Privacy Policy explains what happens to other copies, such as hands kept in your browser and backups.
If we need to act
We may suspend or close your account, or limit what you can do, if you seriously or repeatedly break these Terms, if the law requires it, or if your use puts other people or Ditto at risk. We'll tell you why where we can (see section 7).
If we decide to close your account for any other reason, or to stop offering Ditto, we'll give you at least 30 days' notice where we reasonably can, so you can export your data, and we'll refund any fees you've paid for time after the closing date.
Sections 5, 8 and 14 to 17, and any others that by their nature should continue, still apply after these Terms end.
14.Disclaimers
Ditto is provided "as is" and "as available". As far as the law allows, we make no promises or warranties about Ditto beyond those in these Terms, whether express or implied, including warranties of merchantability, fitness for a particular purpose and non-infringement.
In particular, we don't promise that a learned hand will look exactly like your writing, that pages will be read without mistakes, or that the Assistant's output will be correct or suitable for your purpose.
Nothing in these Terms takes away rights you have as a consumer that the law says can't be taken away.
15.Limitation of liability
Nothing in these Terms limits or excludes our liability for death or personal injury caused by our negligence, for fraud, or for anything else that the law doesn't allow us to limit or exclude.
Subject to that, and as far as the law allows:
- we're not liable for indirect, incidental, special, consequential or punitive losses, or for loss of profits, revenue, business, data or goodwill; and
- our total liability for all claims about Ditto is limited to the greater of the amount you paid us in the 12 months before the claim arose and US$100.
If you're a consumer in the UK or the EU, we're responsible for loss or damage you suffer that is a foreseeable result of our breaking these Terms or failing to use reasonable care and skill. We're not responsible for loss that wasn't foreseeable. Pencil and Ballpoint are for private use, so if you use them for business, we're not liable to you for business losses.
16.Indemnity
As far as the law allows, you agree to cover our reasonable losses and costs (including reasonable legal fees) from any claim by someone else that arises from your content, from your use of Ditto in breach of these Terms, or from your breaking the law or someone else's rights. We'll tell you about any such claim promptly. This section doesn't apply to you as a consumer where the law where you live doesn't allow it.
17.Governing law and disputes
These Terms, and any dispute about them or about Ditto, are governed by the law, and decided by the courts, set out here: [Governing law and courts].
If you're a consumer, you also keep the protection of the mandatory laws of the country where you live, and you can bring a claim in your local courts where the law gives you that right.
If something goes wrong, please contact us first at [Contact email]. Most problems can be sorted out quickly, and we'll aim to resolve yours within 30 days.
18.Changes to these terms
We may update these Terms, for example when Ditto changes or the law does. Each version has a version number and an effective date at the top of this page.
If a change is material, we'll tell you at least 30 days before it takes effect, by email or in Ditto, unless we need to make it sooner for legal or security reasons. We may ask you to accept the new version when you next sign in, and we record which version you accepted. If you don't agree with a change, you can stop using Ditto and delete your account before it takes effect. If you keep using Ditto after that, the new Terms apply.
19.General
- Whole agreement. These Terms, the Privacy Policy and any plan details shown when you buy are the whole agreement between you and us about Ditto.
- If part is invalid. If a court finds that part of these Terms can't be enforced, the rest still applies.
- No waiver. If we don't enforce a right straight away, we can still enforce it later.
- Transfer. We may transfer these Terms to another organisation, for example if Ditto is sold or merged, and we'll tell you if that happens. A transfer won't reduce your rights under these Terms. You may not transfer your account or these Terms without our written consent.
- Events outside our control. We're not responsible for delays or failures caused by events beyond our reasonable control.
- No third-party rights. Only you and we have rights under these Terms.
- Notices. We'll send notices to the email address on your account, or show them in Ditto. You can send notices to us at [Contact email] or [Postal address].
